FEES AND COSTS
PRENUPTIAL AGREEMENTS
Our law firm generally handles Prenuptial Agreements on a flat fee basis. That is, our firm charges a set fee for handling the matter from beginning to end rather than on a retainer and hourly charge basis. The following standard fees anticipate a “routine” prenuptial agreement, such as is encountered in 95% + of cases. Fees may be slightly higher in cases which involve review of complicated Trust instruments or special tax issues. In our experience, clients prefer to know exactly what their legal costs will be before they decide to proceed.
Our firm’s flat fee for drafting your prenuptial agreement, in English and Thai : 30,000 Thai Baht + 7% VAT
(approximately $1,000 USD +7% VAT at current exchange rates)
In representing you in your prenuptial agreement, our firm will:
- Advise you in determining whether a prenuptial agreement is even necessary or desirable in your specific circumstances.
- Review your assets and, if necessary, your current estate plans, Trust Agreements, etc.
- Advise you in respect to whether your specific personal objectives can be accomplished with a prenuptial agreement, various alternative means of accomplishing your objectives and, how best to accomplish your objectives.
- Draft and revise as necessary a prenuptial agreement tailored to your specific situation and circumstances to produce a final prenuptial agreement, in English and Thai.
- Consult with counsel for your fiancée on any issues of contention and advise you accordingly so that you may make informed choices.
PLEASE NOTE: It is a critical component of enforceability of prenuptial agreements that both fiancé and fiancée be represented by separate counsel. We cannot ethically represent both parties to a prenuptial agreement and, it would not be in our client’s best interest to do so as it would put the enforceability of the agreement into serious question. We are happy to work with any counsel selected by the other party to represent them. If the Thai fiancée knows no counsel qualified to represent them, we will be happy to provide the names of qualified attorneys to act as their representative who are fluent in both Thai and English and, knowledgeable about prenuptial agreements but who do not work for our law firm. Typically, attorneys representing the Thai fiancée charge approximately 10,000 Thai Baht + VAT but, fees can and do vary widely. - Provide our offices for final meeting to execute the agreement including provision of notarial services.
- If the couple intends to register their marriage in Bangkok, our legal staff will also attend the marriage registration to ensure proper recordation of the prenuptial agreement at the Amphur (District Office).
